The University at Buffalo Information Technology (UBIT) operates as a covered entity as defined by the U.S. Department of Health and Human Services Office of Civil Rights. HIPAA Regulation Text 45 CFR Part 164.308 (a)(7)(i) requires a covered entity to establish and implement policies and procedures for responding to an emergency or other occurrences (for example: fire, vandalism, system failure, natural disaster, etc.) that damage systems containing ePHI.
UBIT establishes and implements documented emergency response policies and procedures in order to prepare for and respond to emergencies, disasters, and other occurrences (for example: fire, vandalism, system failure, natural disaster, etc.) that damage systems containing ePHI.
The documented emergency response is collectively referred to as a Contingency Plan. The Contingency Plan includes, but is not limited to: back-up procedures, emergency mode operation plans, testing and revision procedures, and applications and data criticality analysis.
This policy applies to all UBIT workforce members.
Workforce members: Adhere to all policies and procedures as written.
HIPAA Security and Privacy Officer: Responds to an emergency, disaster, or other occurrence (for example: fire, vandalism, system failure, natural disaster, etc.) that damages systems containing ePHI.
Compliance Officer: Participates in ensuring the implementation of policies and procedures to promptly identify, report, and respond to security incidents in conjunction with the HIPAA Security and Privacy Officer.
