The University at Buffalo Information Technology (UBIT) operates as a covered entity as defined by the U.S. Department of Health and Human Services Office of Civil Rights. HIPAA Regulation Text 45 CFR Part 164.308 (a)(8) requires a covered entity to perform a periodic technical and non-technical evaluation, based initially upon the standards implemented under this rule and, subsequently, in response to environmental or operational changes affecting the security of ePHI, that establishes the extent to which a covered entity's or business associate's security policies and procedures meet the requirements.

UBIT performs a periodic technical and non-technical evaluation, based initially upon the standards implemented under this rule and, subsequently, in response to environmental or operational changes affecting the security of ePHI. The evaluation establishes the extent to which a covered entity's or business associate's security policies and procedures meet the requirements.

This policy applies to all UBIT workforce members.

Workforce members: Adhere to all policies and procedures as written.

HIPAA Security and Privacy Officer: Implements procedures for performing periodic technical and non-technical evaluations to protect ePHI.

Compliance Officer: Participates in and/or initiates performing periodic technical and non-technical evaluations to protect ePHI, in conjunction with the HIPAA Security and Privacy Officer.
